not sure what caused it. >> catherine: new tonight.this is the woman menlo park police say was driving drunk when she hit and killed two pedestrians early friday. she's 54-year-old marjorie reitzell, of redwood city -- this is her booking photo. she's charged with two felony counts of manslaughter and two counts of felony driving under the influence. she's still getting medical care - and was not in court for her arraignment today. prosecutors say reitzell's blood-alcohol level was more than twice the legal limit. >> we know that the contact of the people driving and we had a preliminary blood alcohol level we know that it is well or.5 it is over-.5 and this is not an issue in the case. >> catherine: there's a memorial near the scene of the accident.

the couple killed are 50- year-old balbir singh and his wife, 45-year-old kamal singh, both of menlo park. if convicted, marjorie reitzell faces up to 15 years in prison - and is being held on one-million dollars bail. the d-a says she's still on probation from a 2012 d.u.i. conviction. >> catherine: there's new information on the sonoma county deputy who shot and killed 13 year old any lopez last week in santa rosa. the deputy is 48-year-old erick gelhaus. he's a 24 year veteran of the sheriff's office - and is a field training officer and firearms instructor. he and another deputy were on patrol when they spotted lopez with what turned out to be a replica ak-47. several agencies are investigating the shooting - including the f.b.i. community leaders are planning a march tomorrow in santa rosa to demand more information.

>> tis the season.a chill in the air.and a new flu warning.as cases steadily climb in the u-s. the centers for disease control is urging parents to get your kids vaccinated for the flu, even if they're otherwise healthy. a new report found that nearly half of kids who died from flu complications had no other medical conditions or risk factors for complications. researchers say about 830 children died from flu- related complications between 2004 and 2012. the c-d-c says children should start getting yearly

danville. and we have a live picture from our camera on mount tam. the forecast - coming up. and - the storm is also bringing the first snow to the sierra this season. we have a reporter there. ahead. >> catherine: this time last year -- millions of people in the northeast were bracing for a huge storm named sandy. it washed away homes - devastated entire communities and changed a coastline forever. now - one year later - most of the debris is gone - and new homes are sprouting up. you can see the difference in these before and after pictures. the first two were taken in breezy point, new york. the last - taken in belle harbor where a storm surge wiped away almost everything along the coast. but communities are making a strong comeback. the one year anniversary of sandy is tomorrow. the storm killed more than 100 people - and did billions in damage. since then, the national hurricane center has made big changes in how they issue their forecasts. john zarrella explains. >> reporter: for the people

who lived through it, hurricane sandy was a nightmare. for emergency managers and forecasters sandy was a nauseating mess. >> "we had a difficult dilemma on our hands." >> reporter: hurricane center director rick knabb says next timethere won't be a dilemma. why, requires looking at what happened. forecasters knew sandy was morphingbecoming a super storm. while it had hurricane force winds and pushed that wall of water called storm surge towards the coastline, by the time it made landfall it wouldn't be a hurricane -- technically. >> "of all the disasters we deal with, hurricanes are the one we map and spend a lot of time trying to figure out who's at risk and then get the messaging out there for them to evacuate in time to leave." are >> >> reporter: but the message may have been missed. there wasn't a hurricane warning because again, technically, sandy wasn't one. to avoid what it felt would be confusion and misrepresenting the storm, the national weather service

decided to go with high wind and flood warnings. >> "there is no doubt that the phrase 'hurricane warning' is more attention getting." >> reporter: it's impossible to say whether some lives would have been saved if the attention getting phrase would have been in place. but in the wake of sandy policy has changed allowing watches and warnings to go up regardless of what you call the storm. there are other changes coming too, part of an ongoing process, in the works even before sandy. evacuation zones are changing from maine to texas because hurricane forecasters and researchers have a better understanding than a decade ago of the storm surge from monsters like sandy. >> "when you put those big storms into our models they produce more surge so we redid all of our modeling which meant that everybody had to update their evacuation zones which means evacuation zones have gotten larger." >> reporter: another new model will make it easier for people to look at and

evaluate their risk from storm surge. all of these new tools are designed to make sure the public gets the message. john zarrella cnn miami. >> catherine: ellis island has reopened to visitors - for the first time since sandy hit the new york harbor. the storm left the island - which was a first stop to millions of immigrants - without power for months. even though it has reopened - the park service says there's still a lot of work to be done. >> in the uk, people are waking up to what could be the heaviest storm in a decade. it's cut off the electricity to more than 140-thousand homes. and we could see that number rise. rescuers braved rough waters on sunday evening, searching for a missing teenager. they said the boy was swept out to sea on the south coast. he has not been found yet. wind gusts measured over 93 miles per hour in some areas. scaffolding in london falls

>> now at 5:30. the owners of a nursing home in castro valley, say they'll fight to re-open. a criminal investigation continues into how a dozen patients were abandoned by their caregivers. for several days. those residents - some of them bedridden or in wheelchairs - are safe tonight.either with family or at local hospitals after being evacuated saturday. kron4's maureen kelly says the facility where they were living has a long history of problems. >> reporter: yellow crime scene tape still blocks the driveway at the valley manor community care home.the residential care home was in

the process of being shut down by the state.the operators.herminigilda manuel and mary manuel.had their liscense to operate temporarily suspended on thursday by the california department of social services.a spokesperon for that agency says they were monitoring the situation and had been assured that there would be adequate staffing thru the weekend while the residents were helped to find new homes..but in the end at least two janitors and a cook stayed behind to help the 14 elderly patients still living at the facility.but those unpaid the authorities to help. this is complaint which lists the allegations against the two operators.of violations at the castro valley facilty.and two others.one in oakland which the pair no longer runs and a modesto location which is currently getting new administrators. the allegations include patients not getting proper

care.including one incidnet where a client had a seizure after not getting with dementia was alledgely not properly supervised and wandered away.returned by police two days later.the castro valley facilty had fire code violations and back in september was found to have inadaquete staffing.the facility itself.reportely dirty and in disrepair. other staff making false statements to patients and report patient falls.and multiple employees allowed to work without criminal records clearances. the state is seeking to bar the manuel's from ever operating a residential care facility for the elderly.or even being allowed to work in one. maureen kelly kron4 news. >> catherine: the lawyer for the owners contacted kron 4. to say that the employees who remain are two caregivers and a dietary supervisor. he says that's adequate staffing for the number of tonight --on kron4 news at 8 - we'll look deeper into the owner's side of the story. >> there was a 27 year-old woman that hit a pedestrian. it was believed that the driver was driving under the

all molested by jerry sandusky when they were children. the former assistant football coach is effectively serving a life sentence. the university president calls the agreements a step forward in the healing process. the school could still face >> jodi air-ree-as wants to fire her lead attorney. she was convicted last may of killing her former boyfriend in 2008. she's complaining in a letter that her attorney kirk nurmi doesn't have much tolerance for what she calls her "emotional and psychological shortcomings". she actually tried to have him removed from the case in june - but a judge said no. air-ree-as has not been sentenced yet - and could face the death penalty. >> catherine: a charge against singer chris brown has been reduced to a misdemeanor - and he's been ordered released. brown was in a court in washington today. he was charged with felony assault after he was arrested sunday following a fight outside a washington hotel. cnn's rosa flores looks at brown's troubled past. and what the latest incident

12:30 this afternoon - in a two story building on valencia street. the fire spread to other buildings - including a pilates studio. because the buildings are so closely packed together here, when firefighters arrived -- the fire was upgraded to three alarms almost immediately. >> they called a three alarm. we had approximately 100 fire fighters on scene here. they were able to prevent it from spreading any further than the buildings on either side and the one behind it >> catherine: ofno one was injured.but half a dozen people had to be evacuated from the buildings. crews put the fire out around 2 pm. >> former santa clara county supervisor george shirakawa was indicted and arraigned on charges today related to how he handled his campaign reports and finances. he was arrested in june. shirakawa blamed his problems on depression and a gambling addiction. he's set to be sentenced for some of the charges - november 8th.
